Janet | Cosmetic surgery negligence

Janet sought compensation after cosmetic surgery left her with scarring. She had sought the surgery on both the upper and lower eye lids, including eye bag removal, an laser surgery around the mouth, a forehead and neck lift and the removal of 3 facial moles from the side and underneath of the chin.

Immediately after surgery Janet was in extreme pain and had severe swelling. She was discharged without medication the next morning despite being in pain and her wounds continuing to bleed.

Janet had to go back to the clinic on various occasions after the wounds re-opened. At one point she was even told that her eyes were the worst the defendant had ever seen. The defendant later indicated that he had performed one of the operations too tightly.

A court case was brought against the defendant as he had failed to refer her to a competent surgeon when the first attempt at surgical revision failed. It was alleged that the defendant had performed unnecessary surgery without benefit to her in an attempt to rectify the mistakes made earlier.

Experts ruled that the standard of care provided was unacceptable, and that Janet’s injuries were directly attributable to the defendant. Besides the physical scarring, Janet was also left with depression, a lack of confidence and self-consciousness. Because Janet had a history of vulnerability and depression, the court ruled that the defendant should have made further enquiries with Janet’s GP.

A final settlement of £45,000 was awarded.
