The injuries occurred as J was leaving work. Large iron gates swung back and hit her on back of her heel causing a 4cm laceration. She was treated at the Royal Berkshire Hospital where she received stitches and was absent from work for six weeks.
J underwent excision of the neuroma which developed and is likely to require surgery in the future.
In addition her walking tolerance will remain restricted to only 2 miles, she will not be able to run and her choice of footwear will be limited.
Further surgery may be an option if the pain becomes unmanageable, but this is not guaranteed to resolve her ongoing problems.
Counsel originally valued the case at £11,750 but after making an offer, and after lengthy negotiations, we managed to achieve settlement for our client of £20,000. This was mainly on the basis that she was disadvantaged on the open labour market and may never be able to do her job as a beauty therapist, undertaking mainly massage, on a full-time basis.
