Back injury compensation success
Injury+ members Boyes Turner settled a case for a 44 year old man for £125,000.
The man fell over some plastic strapping at work and sustained an injury to his back. His first solicitors advised him that his case was worth £3,000 to £4,000.
Boyes Turner took over the case a couple of years after the accident occurred and obtained orthopaedic and psychiatric evidence, which identified that he had sustained a relatively minor soft tissue injury to his back, symptoms from which should have resolved within a relatively short time.
However, the man developed a Chronic Pain Reaction, a recognised psychiatric disorder which meant that he believed he was in chronic pain even though there was no organic explanation for it.
The man was unable to return to work, required large amounts of care on a daily basis and became wheelchair bound.
The medical evidence also showed that he had a pre-existing orthopaedic condition which meant that had the accident not occurred he would have gone on to develop low back pain and the chronic pain reaction within about 5 years in any event.
This meant our claim was limited to 5 years pain and suffering, loss of earnings and care hence the settlement at £125,000. This was however, considerably more than had initially been expected by the other solicitors.
