Berkshire Rail Crash
It is reported that seven people have lost their lives and dozens have been seriously injured in a train crash in Berkshire.
It is alleged that the crash occurred because the driver of the stationary car deliberately positioned himself on the track because he "just wanted to die". If this proves correct the cause of this train crash will be distinguishable from earlier rail accidents, which focused solely on fundamental flaws in the British Rail system.
For the innocent victims of an accident involving vehicles the law does provide redress.
If the driver of the vehicle is insured then the insurer may be liable for loss or injury caused by the driver of the car regardless of whether the driver had criminal intent or was engaged in a deliberate act (e.g. suicide).
If the driver of the vehicle is uninsured then the Motor Insurers Bureau may compensate the victims. The Motor Insurers Bureau was established in 1946 with the aim of compensating the victims of uninsured and untraced drivers.
Injury+ members are co-ordinating claims on behalf of those involved in case it emerges, as suspected, that the driver was uninsured at the time of the accident.
In the event that the car driver was uninsured a joint approach with the Motor Insurers Bureau will be agreed to ensure that the victims of this incident are provided with clear advice, support and assistance at an early stage.
